Terms of sale and service

The terms that apply when you buy from us

These terms cover the sale of used vehicles, the services listed on our pricing page, deposits, cancellation and refunds, and the limits of what we commit to. They are written to be read rather than to be skipped.

1. Who these terms apply to

The parties

2. Service scope

What we do and what we do not do

What we provide

The sale of used motorcycles and light motor vehicles, together with the services published on our pricing page at the rates shown there.

  • Used motorcycles and light motor vehicles
  • A written condition sheet for each vehicle offered
  • V5C/2 completion and online keeper change submission
  • Delivery, storage and preparation services at published rates

What we do not provide

We are a dealer, not a lender, an insurer or a warranty provider. The following are outside the scope of what we sell.

  • Credit agreements or any form of regulated lending
  • Extended warranties, mechanical breakdown cover or guarantees
  • Insurance for the vehicle, its riders or its drivers
  • Road tax, which remains the registered keeper’s responsibility

4. Cancellation and refunds

How cancellation works and when a refund is due

This section sets out the cancellation and refund position in full. If you are unsure how it applies to your situation, ask before you pay anything.

Cancellation

You may cancel a booking, a hold or a pending purchase at any time by telephoning or emailing us. The earlier you tell us, the better the position for both sides, because a vehicle held off the list cannot be sold to anybody else.

  • Tell us as soon as your plans change
  • Holding deposit terms are those written at the time of payment
  • Where we can resell the vehicle promptly, deposits are returned in full
  • Where work has already been carried out, the cost of that work is not refundable

Refunds

Where a service has been paid for and we are unable to perform it, the fee is refunded in full to the account it came from. Where a service has already been performed, the position is set out in writing before you pay.

  • Full refund where we cannot deliver a paid service
  • Refund to the original payment method
  • Refunds processed without a handling charge
  • Your statutory rights are unaffected by anything in this section
5. Condition and no-guarantee clause

What we warrant and what we do not

What we state

Every vehicle is sold as used stock with the condition recorded in writing at the point of sale. The condition sheet describes what was checked and what was found, including known faults.

  • Condition described in writing, not in adjectives
  • Known faults disclosed before money is paid
  • The sheet forms part of what you are buying
  • You are encouraged to inspect or have the vehicle inspected

What we do not state

We do not state that a used vehicle is free of faults, that it will remain free of faults, or that it is suitable for a purpose you have not told us about. No warranty period is sold or implied.

  • No warranty period is offered or implied
  • No claim that a vehicle is free of future faults
  • No claim of fitness for an unstated purpose
  • Your statutory rights continue to apply
6. Obligations of both parties

What each side is responsible for

Our obligations

We commit to a defined and limited set of things, and we do not go beyond them in conversation.

  • Describe the vehicle honestly and in writing
  • Disclose known faults before payment
  • Complete the keeper change paperwork promptly
  • Perform paid services within the agreed timescale

Your obligations

Most disputes that arise in this trade trace back to one of these four things being skipped at the point of sale.

  • Hold the correct licence category for the vehicle
  • Arrange insurance and tax before you ride or drive away
  • Declare any outstanding finance on a part exchange
  • Read the condition sheet and ask about anything unclear
7. Liability and governing law

The limits, and which law applies

Limitation of liability
Our liability in connection with a vehicle sale or a paid service is limited to the amount you paid us in that transaction, except where the law does not permit such a limit, including liability for death or personal injury caused by our negligence.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
Consumer rights
Nothing in these terms excludes or restricts any right you have under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.
Changes to these terms
We may update these terms from time to time. The version that applies to your transaction is the one published on the day you bought from us, and a copy is available on request.
Next step

Ask for a copy of these terms before you buy

We will email or print these terms on request, and we will walk you through any section that is unclear. Nobody should be agreeing to a term they have not read.
